Interests. To receive disclosures of personal and prejudicial interests from Councillors on matters to be considered at the meeting in accordance with the adopted Code of Conduct 2007. The disclosure must include the nature of the interest. If you become aware, during the course of a meeting, of an interest that has not been disclosed under this item you must immediately disclose it. You may remain in the meeting and take part fully in discussion and voting unless the interest is prejudicial.

 

A personal interest is prejudicial if a member of the public with knowledge of the relevant facts would reasonably regard it as so significant that it is likely to prejudice your judgement of the public interest and it relates to a financial or regulatory matter.

 

Members are reminded to repeat the declarations when the items are announced by the Chairman.

At the Chairman's discretion, members will be allowed to make their representations etc. at the beginning of the appropriate agenda item and to leave the meeting during the representations made by the public and the deliberations of the Committee.

Budget Car Company. The activities of the Budget Car Company have caused objections from local residents. A local businessman has also objected because he has had to pay ESCC for permission to cross a grass verge in Gammons Way in order for vehicles to leave Pumphouse Yard whereas the fence has been removed by the Budget Car Company and cars have easy access to the B2244 from that land without payment.

 

The original planning permission for "Use of land for display of cars for sale and parking" dates back thirty years to 1980. The application has been studied and, it would appear, that the land is not being used in accordance with the original planning permission. A condition was imposed at that time "in the interests of and for the safety of persons and vehicles using the premises and/or the adjoining road" that "adequate turning facilities shall be provided for all vehicles using the site". In addition, the application plan shows a 5ft grass verge and 18" high white painted ranch type fencing. The application description on the form was "Use of land with frontage on A229 for display of cars for sale. Use of land at rear for customer and MOT parking. No change of use for building".

 

To Resolve: That the Parish Council writes to Rother District Council strongly objecting to the unsightly use of land within the Sedlescombe Conservation Area and requesting that Budget Car Company is required to alter the use of the car sales land to bring it into line with the Plans and Planning Approval for Application RR.80.2363 as follows:

  1. Reinstatement of the 5ft wide grass verge between the land and the B2244.
  2. Replacement of the 18" white painted ranch type fence bordering the B2244.
  3. Restriction of car sales to land delineated on the RR.80.2363 plan - NB This excludes the pumping station entrance and the land to the south of it.
  4. Restriction of car sales to one line bordering the B2244 leaving the land at the rear of the site for customer parking and turning within the site.

In addition that the Budget Car Company should remove the extension currently attached to the building on the land which has been refused planning permission on two occasions.
